Terms of Service & Atelier Agreements

Effective Date: January 1, 2026 Jurisdiction: High Court of Delhi, New Delhi Applicability: Global Digital Users & Atelier Clients

1. Acceptance of Terms

By accessing the web portal viblysunnypatch.homes or engaging the bespoke couture styling services of Viblysunnypatch Heritage Apparels & Textiles Pvt. Ltd. (Company No. 14920412), you agree to be bound unconditionally by these Terms of Service. If you do not consent to all provisions herein, you must immediately cease utilization of this portal.

2. Intellectual Property & Archival Rights

All textual research, curated historical documentation, photographic imagery, garment schematics, motif analyses, and visual marks displayed across Viblysunnypatch are the exclusive intellectual property of the Company or its verified heritage contributors. No portion of this compendium may be reproduced, scraped via automated bots, distributed, or modified for commercial purposes without prior written authorization from our legal counsel.

3. Nature of Handcrafted Textiles & Artisanal Disclaimers

Clients and readers acknowledge that genuine Indian handlooms (including Banarasi Katan silk, Chikankari needlework, and Khadi) are produced on manual pit and frame looms by individual human artisans.

Artisanal Uniqueness Clause: Minor variations in weave tension, subtle dye slubs, thread ends on reverse sides of cutwork weaves, and individual needle-stitch densities are natural hallmarks of authentic handcraftsmanship and shall not be deemed manufacturing defects.

4. Bespoke Bridal Orders, Fittings & Cancellations

For bespoke couture, trousseau ensembles, and custom handloom weaving runs:

  • Measurement Accuracy: The client is solely responsible for verifying the accuracy of measurements submitted remotely. We strongly recommend scheduling an in-person or live video session with our master drapers.
  • Custom Commission Non-Refundability: Because handwoven bridal kalis and tailored corsets are individually crafted to personal specifications, custom orders cannot be cancelled or refunded once yarn dyeing or loom warp setup has commenced.

5. Limitation of Liability & Dispute Resolution

In no event shall Viblysunnypatch, its directors, master weavers, or employees be liable for indirect, incidental, or consequential damages resulting from portal downtime or third-party carrier delays. Any legal dispute arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, DL, India.
